Aqua-wheelchair performs flips underwater

We've showed you thought-controlled wheelchairs and a design that can dock like a spaceship. But now a new aqua-wheelchair can propel itself underwater, allowing disabled divers to perform acrobatic moves.

Developed by artist Sue Austin with the help of engineers and diving experts, the current prototype uses two dive propulsion vehicles and is steered by a foot-operated acrylic strip and bespoke fin. By placing the thrusters underneath the chair, the force is applied below the centre of gravity, making it easier to do flips in the water. A key challenge was keeping the chair buoyant, but this was achieved using simple swimming floats.

Austin is demonstrating her underwater choreography this week as part of a series of events related to the Paralympic Games, where the audience can join her underwater.

'Books, Antiques and Apples' ? Chateau Cargill Wedding Photography

Michelle and Devon got married in Surrey BC at the Chateau Cargill.

They ?both got ready at their house in Langley, bride on the main floor, and the groom in much cooler basement! Then we went and did photos down the road deep into the property. The mosquitos were vicious, but the photos turned out well.

Then it was off to the chateau. Their entire theme was intricately thought out, from each book being carefully picked to go with the colours, to all the knick-knacks placed on the pillars and throughout the decor.

It was a beautiful wedding, and we were so happy to be able to shoot it.

Energy drink makers face NY state probe

(Reuters) - The New York State Attorney General issued subpoenas in July to three firms that make energy drinks, including PepsiCo Inc, seeking information on the companies' marketing and advertising practices, a person familiar with the matter said on Tuesday.

Besides Pepsi, maker of AMP, Attorney General Eric Schneiderman also sent subpoenas to Monster Beverage Corp and Living Essentials LLC, maker of the 5-Hour Energy drink, said the source, who declined to be identified, citing lack of authorization to speak to the media.

A spokeswoman for Schneiderman declined to comment, as did PepsiCo.

Living Essentials also declined to comment beyond its July offering memorandum in which it said that it had recently received an inquiry from a state attorney general asking for documents relating to its product and marketing.

The company said in the memorandum, which was distributed in connection with a debt offering, that it was responding to the inquiry.

Monster also declined to comment beyond its August U.S. Securities and Exchange Commission where it stated that it had received a subpoena from an unspecified state attorney general. Coca-Cola and Dr Pepper Snapple, which make the NOS and Venom energy drinks respectively, said at the time that they did not receive subpoenas.

Schneiderman is examining whether the companies overstated the benefits of ingredients in the drinks while understating the role of caffeine, a common stimulant that industry critics believe to be the main active ingredient, the source said.

At least one Wall Street analyst found comfort in the narrow scope of the subpoenas.

"We think changes to labeling and marketing related to source of stimulant are unlikely to materially impact energy drink sales," Stifel Nicolaus analyst Mark Astrachan wrote in a research note.

Energy drinks, which can have less caffeine per ounce than strong coffee, make up a fast-growing sector of an otherwise stagnant market for carbonated soft drinks.

Monster is the leading U.S. energy drink by volume with nearly 39 percent of the U.S. market, but Austria's Red Bull has the highest share by revenue, due to its premium price.

The latest move on the energy drink industry follows New York City Mayor Michael Bloomberg's plan to propose a far-reaching municipal ban on sales of large-size sugary beverages by restaurants, mobile food carts, movie theaters and delis.

Monster shares were down less than 1 percent at $59.51 in afternoon trade on the Nasdaq. PepsiCo was up 2 cents at $73.19 on the New York Stock Exchange.

Mississippi River flows backwards due to Isaac

ScienceDaily (Aug. 29, 2012) ? Strong winds and storm surge from Hurricane Isaac's landfall forced the Mississippi River to flow backwards for nearly 24 hours on Tuesday, August 28. The USGS streamgage at Belle Chasse, Louisiana, showed the Mississippi River flowing upstream at 182,000 cubic feet per second, surging to 10 feet above than its previous height. Average flow for the Mississippi River at Belle Chase is about 125,000 cfs towards the Gulf of Mexico.

Although it doesn't happen often, hurricanes can cause coastal rivers to reverse flow. Between the extremely strong winds and the massive waves of water pushed by those winds, rivers at regular or low flow are forced backwards until either the normal river-flow or the elevation of the land stop the inflow.

As Hurricane Isaac pushes further inland, it is causing storm surge in the Mississippi River as far north as Baton Rouge, where the river has crested at 8 feet above its prior height.

"This reversal of flow of the mighty Mississippi is but one measure of the extreme force of Isaac," said USGS Director Marcia McNutt. "While such events are ephemeral, they are yet another reminder of why we need to respect hurricane warnings."

When Hurricane Katrina came ashore in 2005, the Mississippi River also reversed flow, cresting at 13 feet above its previous level, with Baton Rouge reaching 9 feet above its previous stage as well.

Another phenomenon that USGS streamgages have recorded as Hurricane Isaac moves inland is that periodically, coastal rivers in Louisiana have lost height, only to gain it back again soon after. This rising and falling of the rivers is a common occurrence during hurricanes and is caused by the spiral nature of these storms.

As the winds sweep to the southwest, they force water out of the rivers, lowering their height. However, once the winds complete their turn to the southwest, they begin back to the northeast, allowing the storm surge to raise the river levels.

These oddities in river behavior are recorded in real-time by USGS' extensive network of streamgages, located through Louisiana and the rest of the country. These streamgages, which are installed along rivers and streams, record data like streamflow, river height, and, in some cases, even water chemistry.

Many transmit their data in real-time to satellites, updating with new information every 15 minutes. This wealth of data allows USGS scientists, emergency managers and responders, and even the general public to have accurate and up-to-date knowledge of what the rivers and streams in their areas are doing. This data is particularly critical during massive flooding events like Hurricane Isaac.

In fact, anyone can sign up to receive notices from USGS streamgages when waters are rising in nearby rivers and streams through a program called WaterAlert (http://water.usgs.gov/wateralert/). It is a free service that allows members of the public to receive notifications about water levels at any of over 7,000 USGS real-time streamgages around the country. Neil Armstrong, first man on moon, dies at 82

Apollo 11 commander held true to his engineering roots

Neil Armstrong landed and walked on the moon, the first of just a dozen men to do so. He died in Ohio on August 25, at age 82.

?Houston, Tranquility Base here,? he told NASA?s mission control after piloting the Apollo 11 lunar module to the surface on July 20, 1969. ?The Eagle has landed.?

Six and a half hours later, Armstrong climbed down the spacecraft?s ladder and stood for a moment on one of its saucer-shaped footpads. Then he stepped lightly to the left and into the lunar dust. ?That?s one small step for a man, one giant leap for mankind,? he said to hundreds of millions of people watching the live television broadcast. (The ?a? in his comment was not audible to those on Earth, but Armstrong later insisted he said it, and a 2006 audio analysis supported him.)

Armstrong?s life was forever defined by that day, but he defined himself foremost as an engineer. He once called himself ?a white-socks, pocket-protector, nerdy engineer ? born under the second law of thermodynamics, steeped in the steam tables, in love with free-body diagrams, transformed by Laplace and propelled by compressible flow.?

Armstrong was born and grew up in Wapakoneta, Ohio, where he worked odd jobs to pay for flying lessons and earned his student pilot?s license on his sixteenth birthday. With a U.S. Navy scholarship he went on to study aeronautical engineering at Purdue University and then earn a master?s in aerospace engineering from the University of Southern California. Armstrong flew 78 combat missions for the Navy during the Korean War.

In 1955 he joined the National Advisory Committee for Aeronautics, the predecessor to NASA, as a test pilot. Seven years later he joined NASA?s second astronaut class and got the job of piloting the 1966 Gemini 8 mission, the first rendezvous between two spacecraft. In orbit a thruster malfunctioned, sending the docked spacecraft into a nauseating spin. Armstrong disengaged from the second craft and got Gemini under control for a safe return to Earth.

Those nerves of steel ? and experience flying more than 200 kinds of aircraft ? came in handy many times during Armstrong?s career.

NASA assigned him to be commander of Apollo 11, the first attempted moon landing. While Michael Collins orbited overhead, Armstrong and Edwin ?Buzz? Aldrin descended to the surface in the lunar module. Armstrong, though, saw that the computer was taking them towards a boulder-strewn landing site; he overrode the computer?s instructions and piloted the module down with just seconds of propellant left to spare.

?You got a bunch of guys about to turn blue,? mission control told him. ?We are breathing again. Thanks a lot.?

Armstrong and Aldrin roamed the lunar surface for more than two hours, picking up 46 pounds of rocks and soil and leaving behind a seismometer, an American flag and other mementos. On returning to earth, they and Collins spent three weeks in quarantine in case they had brought back any extraterrestrial microbes.

After Apollo, Armstrong worked at a NASA desk job, then retired from the agency in 1971. He returned to Ohio and taught aerospace engineering at the University of Cincinnati for eight years, then worked in the aerospace business. Armstrong continued to serve on various policy committees, including NASA?s panel investigating the 1986 explosion of the space shuttle Challenger and a National Academy of Engineering group on the greatest engineering achievements of the 20th century.

After 1972?s Apollo 17 became the last NASA mission to carry moonwalkers, Armstrong wanted the agency to return astronauts to the moon. In 2008, for NASA?s 50th anniversary, he told an audience that ?the goal is far more than just going faster and higher and further. Our goal ? indeed our responsibility ? is to develop new options for future generations: options in expanding human knowledge, exploration, human settlements and resource development, outside in the universe around us.?

Japan takes LLWS title, beats Tenn. 12-2

SOUTH WILLIAMSPORT, Pa. (AP) ? Arms outstretched in the air with a smile from ear-to-ear, Noriatsu Osaka couldn't contain his glee.

Neither could his teammates from Tokyo after Osaka's third home run of the game put an exclamation point on Japan's 12-2 victory over Tennessee in five innings in the Little League World Series title game Sunday.

The 12-year-old Osaka added a triple for good measure, too, to top off his 4-for-4 afternoon. In a symbolic gesture, Japan's players jogged the traditional postgame victory lap carrying the flags for both their home country and the United States.

"We had such a great time in Pennsylvania and we really played a good game today. It was kind of a, 'Thanks,'" Osaka said through an interpreter.

Starter Kotaro Kiyomiya struck out eight in four innings and added an RBI single for Japan. The game ended in the fifth after Osaka's third homer made it a 10-run game.

"We thought we played the best in the tournament so far, especially to win by the 10-run rule in the finals," said 12-year-old Rintaro Hirano, who homered in the fourth to make it 10-1.

A day after pounding out a 24-16 win over California in the U.S. title game, the Goodlettsville, Tenn., sluggers could only muster two hits ? solo shots by Brock Myers and Lorenzo Butler.

It was a bittersweet final game for two teams that grew close during their two weeks in South Williamsport. They exchanged customary postgame handshakes at the plate before Japan received the World Series championship banner and took their warning-track run.

"Tennessee was our best friends in the U.S. division," Kiyomiya said.

Japan's jog finally stopped in front of the team's giddy cheering section as proud family members and friends stood shoulder-to-shoulder to take pictures through the infield fence.

There were so many highlights, including five home runs off Tennessee pitching.

That was more than enough offense for 13-year-old ace Kiyomiya, who had a fastball clocked in the high-70s, The right-hander with the hitch in mid-delivery pitched like a big-league ace in allowing just one hit.

Regardless, this is still a banner year for Goodlettsville after its exhausting victory Saturday over Petaluma, Calif., for the U.S. championship. That game set a record for most combined runs in the World Series.

The thrilling victory kept the Tennessee players and their families up late into the night.

"(The parents) must have partied harder than the kids did," manager Joey Hale said. "I knew we'd be flat today."

Tennessee lost a 10-run lead in the bottom of the sixth of that game before scoring nine times the next inning to finally put away Petaluma in a Little League classic. Even more impressively, Butler had three homers and a record nine RBIs ? a feat so unique the 12-year-old's name became a trending topic on Twitter.

Butler went deep again off reliever Osaka in the fifth ? Butler's fourth homer in two days ? to cut the lead to 10-2 and give Goodlettsvile some home hope. Tennessee's mini-mashers have proven they can break out any time at the plate.

"It feels really good and it was really great," Butler said simply about his hitting exploits. He said his three homers Saturday were the longest he had hit all season.

Its pitching depth sapped, Tennessee turned to right-hander Justin Smith to start against Japan ? the first time the 12-year-old had pitched in the World Series or in Southeast regional tournament.

"Everybody knew our pitching was depleted and we were bound for a letdown," Hale said. "I'm not saying we were going to beat Japan. I think they were the best team here at everything by far, pitching, hitting. But I think last night is how we want to be remembered."

Leadoff hitter Osaka, 12, didn't waste any time with a first-pitch triple to the right-field corner in the first. Kiyomiya delivered his RBI single two batters later to get the scoring started.

Osaka then homered in the second to left-center, just in front of the "Little League" sign above the fence, before leading off the fourth with his second homer, this time to center, for a 6-1 lead.

The Kitasuna league all-star team from Tokyo won Japan's eighth Little League title and second in three seasons.

While his players danced around in delight after the game, skipper Yoichi Kubo teared up. He kept his composure after managing a team that won the World Series in 2001, "but I was crying this time when we won this game as world champion," he said.

Smith pitched admirably in a tough spot, allowing five runs and seven hits over three innings while striking out three. His team was trying to make history as the first squad from Tennessee to win youth baseball's biggest prize.

Goodlettsville also was the first Tennessee team to advance to South Williamsport since Morristown in 1987. The suburban Nashville crew counts among its fans Rays ace David Price, who is from Murfreesboro.

They might be done with baseball for now, but the celebration is just beginning back home. On Tennessee's social calendar is a visit to the Vanderbilt season opener Thursday night against South Carolina.

"When we get home, it's going to be a carnival," Hale said.

Quake hits off El Salvador; tsunami warning canceled

Updated at 2:56 a.m. ET: A strong magnitude-7.4 earthquake struck off the coast of El Salvador late Sunday, temporarily sparking a tsunami warning.

The earthquake was followed an hour later by a second, magnitude-5.4 temblor, authorities said.

However, the tsunami warning covering Costa Rica, Nicaragua, El Salvador, Honduras, Guatemala, Panama and Mexico was later canceled.?


There were no immediate reports of damages or injuries.

David Walsh, an oceanographer with the Pacific Tsunami Center in Ewa Beach, Hawaii, said a minor, 7.8-inch swell was registered off Acajutla, El?Salvador.

The earthquake struck 74 miles south of Usulutan, El Salvador, the U.S. Geological Survey reported on its website.

The temblor took place at a depth of 32.9 miles at 10:37 p.m. Sunday.

On Sunday, dozens of small to moderate earthquakes struck southeastern California, knocking trailer homes off their foundations and shattering windows in a small farming town east of San Diego. The largest quake registered at a magnitude 5.5 and was centered about three miles (five kilometers) northwest of the town of Brawley, according to the USGS. Another quake about an hour and a half earlier registered at magnitude 5.3. No injuries were reported.

Military hopes nasal spray will prevent suicides

The military is seeing unprecedented mental illness and suicide in its ranks, and is funding research to treat depression and prevent the most tragic of outcomes.

In July, a report released by the military found that mental health disorders in active-duty troops increased 65 percent since 2000. Of the more than 900,000 diagnoses, about 85 percent included cases of adjustment disorders, depression, alcohol abuse and anxiety. This month, the Army reported 38 suspected suicides among active-duty and reserve soldiers in July, the highest monthly number of suicides since record-keeping began a few years ago.?

Col. Carl Castro, director of the Military Operational Medicine Research Program, told NBC News that the military is "leaving no stone unturned" in its hunt to find evidence-based treatments for depression and suicide. Included in its multimillion dollar research portfolio is a grant to evaluate whether a nasal spray using a fast-acting hormone could alleviate symptoms of both depression and suicidal behavior.

The $2.9 million grant will support a three-year development and testing period that will ideally culminate in seeking Food and Drug Administration approval for the medication and delivery device. The grant was awarded in April to Dr. Michael Kubek, a professor of neurobiology at Indiana University.?

Kubek will research the use of Thyrotropin-Releasing hormone (TRH), which is known to act rapidly in relieving depression and suicidal behavior. However, its effects are short-term and the hormone has difficulty crossing the blood-brain barrier. Kubek is aiming to load up nanoparticles with TRH and then deliver them via the nasal spray, which could lengthen the drug's effectiveness and overcome the challenges of getting past the blood-brain barrier.

The military is hopeful that the spray will provide a treatment for the period between when a patient is first diagnosed for depression or suicidal thoughts and when typical anti-depressants become fully effective, which can take three to six weeks.

The clinical trial will compare a few hundred patients split into two groups: one receiving the nasal spray and another getting a similar drug used to treat suicidal behavior and depression. The idea, Castro said, is to determine not only if the spray works, but if it is more effective than current drug therapies. The study will look at whether or not the drug decreases depression and suicidal thoughts.

Should the drug prove effective, Castro said a realistic timeline for putting it in a soldier's hands would be five to eight years to account for possible setbacks and additional studies.

The research is part of a $100 million ?effort to study psychological and mental illness in the Army. Half of that funding is for Army STARRS (Study To Assess Risk and Resilience in Servicemembers), an initiative done in partnership with the National Institute of Mental Health to gather details about the lives and mental health of 55,000 soldiers. The Army hopes that the epidemiological study may eventually identify groups of soldiers whose mental health is most fragile based on an algorithm or formula of factors.

The Army has allocated $18 million for 12 studies looking at treatment for depression and suicidal thoughts. The nasal spray study is the only one in the Army's portfolio to test a drug.?

Despite the fact that suicide ranks in the top 10 leading causes of death in the U.S. ? 36,909 people died by suicide in 2009 according to the latest available figures???clinicians still don't have a set of evidence-based standards for how to effectively treat suicidal patients. Instead, they rely often on a combination of medication and therapy that has shown promise, but has varying degrees of success.

The urgency to find a treatment has become critically important to the military as it searches for answers to its own suicide epidemic.

"We have no real explanation for why they're happening," Castro said of military suicides. The goal, he said, is to base treatment on science as opposed to "medical hunches."

The time it takes to design and execute a study can be frustrating to those waiting for an effective treatment, but Castro said, "at least at the end of the day, we'll know if something does work."

Bootleggers take the big screen in 'Lawless'

The summer entertainment is quieting down, but Shia LaBeouf's bootlegger film, "Lawless," still looks like it might be worth drinking up. And if you're into pirates or zombies, this is a good DVD/Blu-ray week for you.

TUESDAY: 'The Pirates! Band of Misfits'
No, not those pirates -- not the Caribbean, black-eyeliner-addicted Johnny Depp variety. "The Pirates! Band of Misfits" is an animated comedy done in Wallace and Gromit stop-motion style, with Hugh Grant?as the bumbling?pirate captain and Imelda Staunton, Jeremy Piven, Salma Hayek and others also lending their voices. The New Yorker's review?called the action "beautifully staged, delightful and exciting." (Out on DVD and Blu-ray Aug. 28.)

TUESDAY: 'Walking Dead' second season
"The Walking Dead" are still walking, and decaying, and eating, and getting shot all to heck by our scrappy band of survivors in AMC's hit gross-out horror series "The Walking Dead." The second season hits DVD and Blu-ray this week. Yes, this is the season where we finally find out what happens to Sophia -- although many fans burned out on caring about her well before the show did. The visual effects and gripping story about a boy lost at sea will be enough to get me in the theaters. And I?m secretly hoping for a 3D Bengal tiger attack.

It?s amazing how much Daniel Day-Lewis looks like Abe in the teaser posters for the film. Seeing Daniel Day-Lewis in a stovepipe hat might give me goose bumps. I?m hoping to learn more about Lincoln like he really enjoyed skeeball or he was Honest-ish Abe.

Why I?m Excited: I love James Bond. I?ve loved James Bond ever since I saw Moonraker as a kid. I even love Daniel Craig as a more broodish Bond. This is the film I?m most excited to see this fall. What?s not to like? It?ll have Bond girls, gadgets, cars, tuxedos, and big action scenes. The trailer is fantastic and Javier Bardem looks like a madman with his boy band hair.

Why I?m Excited: This is Zemeckis first live action film since 2000?s Castaway. Before that he had What Lies Beneath, Contact, and Forrest Gump. In the words of Larry David, ?Pretty, pretty good.? I would?ve seen anyone in a film from Zemeckis but Flight has the Denzel and Don Cheadle combo ? not to mention the breathtaking shot of Denzel saving the plane from crashing.

Why I?m Excited: I love everybody involved in this project. Is it too soon? Maybe. Will it be cool to have Kyle ?Coach Taylor? Chandler back in my life? Absolutely. If Bigelow can bring the same intensity she brought in The Hurt Locker, we?ll be in for a treat.

Twitter's Trademark Infringement Problem - Traverse Legal - Typepad

You may have heard that users have registered trademark terms on Twitter, and have also impersonated celebrities or other brand names. This is a consistent and ongoing problem for Twitter. The bigger problem, however, is Twitter's statement with regards to liability and their simple process that is required to be undertaken if, in fact, you want to have a trademark infringer or an impersonator removed from their service.

Well, what are these problems? Twitter first requires that any complaint, whether trademark or otherwise, be submitted from the domain name of the complaining party. So, for example, if you are an attorney that represents a party that owns www.something.com, then the attorney must be granted an email address from www.something.com. This requires the client to provide their attorney with an email address.?

My name is John Di Giacomo and I am an attorney with Traverse Legal PLC, where I practice in the areas of trademark infringement, copyright infringement, and other internet-based intellectual property matters. Today I'd like to talk to you about Twitter's ongoing trademark infringement problem.

You may have heard that users have registered trademark terms on Twitter, and have also impersonated celebrities or other brand names. This is a consistent and ongoing problem for Twitter. The bigger problem, however, is Twitter's statement with regards to liability and their simple process that is required to be undertaken if, in fact, you want to have a trademark infringer or an impersonator removed from their service.

Well, what are these problems? Twitter first requires that any complaint, whether trademark or otherwise, be submitted from the domain name of the complaining party. So, for example, if you are an attorney that represents a party that owns www.something.com, then the attorney must be granted an email address from www.something.com. This requires the client to provide their attorney with an email address.

Additionally, a second problem that Twitter currently has is that it does not recognize Common Law trademark rights. It only considers a trademark claim if the trademark is in fact registered.

Common Law trademark rights, as opposed to registered trademark rights, are rights that arise out of the use of a mark in commerce. After a longstanding use of a trademark in commerce, a person or a company may obtain trademark rights in a term within the geographical area in which it was used. These trademark rights are no less important or no less valid than those of a registered trademark. In fact, registration simply grants additional benefits to a Common Law user.

In light of these problems that Twitter has, it faces some pretty significant claims of liability and it's likely in the future Twitter will be sued if it does not, in fact, change its policies with regard to trademark infringement and brand impersonation. Why is this?

Well first, Twitter faces a claim of vicarious liability. Vicarious liability requires a finding that the defendant, in this case Twitter, and the infringer, in this case the user of a Twitter handle, exercise joint ownership or control over the infringing product. Since Twitter exercises ownership and control over the infringing product, it could be held vicariously liable because it has the ability to shut down the infringement.

Additionally, Twitter can be held liable for contributory trademark infringement. Contributory trademark infringement occurs where a party continues to supply a product or service to an infringer when it knows that that infringer is engaging in trademark infringement. In this case, again, Twitter continues to provide its service, the social networking service, to individuals that it knows that are infringing upon the third party's trademarks.

Once it has been put on notice, regardless of Twitter's policy, this duty to cease the infringing behavior applies, otherwise Twitter will be held liable for contributory infringement. These are just some of the ways in which Twitter faces some liability with regard to the way that it currently handles trademark infringement problems and brand impersonation problems.
