TV: Israel security heads halted Iran attack alert

JERUSALEM (AP) ? Israel's prime minister and defense minister ordered the military to go on alert to prepare to attack Iran's nuclear program two years ago, but backed off following opposition from top security officials, an Israeli news show claims in a report to be aired Monday night.

A pre-broadcast news release from Channel 2's Uvda (Fact) show did not say whether a final decision to attack was made.

However, it says the alert order quickly met opposition from then-military chief Lt. Gen. Gabi Ashkenazi, who warned that Israel's enemies would notice the measure and that in itself might touch off a war.

"This accordion produces music when you play it," the statement quotes him as saying. "This is not something you do if you are not sure you want to end up with a military operation."

The statement also said Meir Dagan, then heading the Mossad spy agency, accused Prime Minister Benjamin Netanyahu and Defense Minister Ehud Barak of acting illegally by not seeking formal approval from the Cabinet of ministers.

Netanyahu and Barak "simply tried to steal a decision to go to war," Uvda quotes him as saying.

Netanyahu spokesman Mark Regev said the government wouldn't comment until the full show airs. An excerpt broadcast Sunday night showed Barak saying Ashkenazi told him the military wasn't able to carry out the attack.

Ashkenazi denies that, saying he instead told Barak that an attack at that time "would be a strategic mistake," the statement said.

The two former security officials could not be reached for comment.

Israel does not believe Tehran's claims that its nuclear program is peaceful and designed to produce energy and medical isotopes. It considers a nuclear-armed Iran to be a threat to its survival because of its nuclear program, arsenal of weapons capable of striking the Jewish state, support for anti-Israel militants groups and frequent calls for Israel's destruction.

Netanyahu has repeatedly said the threat of force must be seriously considered, recently warning that the world has until next summer at the latest to keep Iran from building a bomb.

Protecting Against Systemic Risk: Canada introduces amendments to

This article has been contributed to the blog by Edward Sellers and Patrick Riesterer. Edward Sellers is a partner in the insolvency and restructuring group of Osler, Hoskin & Harcourt LLP, and Patrick Riesterer is an associate in the group.

The government of Canada recently introduced Bill C-45, the Jobs and Growth Act, which includes amendments to several provisions of the Canada Deposit Insurance Corporation Act (the ?CDIC Act?) and the Payment Clearing and Settlement Act (the ?PCSA?), two statutes that deal in part with the insolvency of financial institutions in Canada.?

The amendments appear to have been introduced, in part, to meet commitments made by Canada and other G-20 countries at the 2009 Pittsburgh Summit of G-20 leaders, where the G-20 agreed that ?All standardized OTC derivative contracts should be traded on exchanges or electronic trading platforms, where appropriate, and cleared through central counterparties by end-2012 at the latest.? The amendments appear to support this objective by clarifying the scope of the certain exemptions from the stay of proceedings for the termination of certain derivatives contracts (?EFCs?), netting of obligations under such contracts and dealing with financial collateral related to such contracts (the ?EFC Safe Harbours?).

These statutes and the amendments to them are highly complex. Readers are cautioned that as this is a summary overview of select issues only and should not be relied on as a replacement for a detailed review of the law.

Current Law ? The CDIC Act

The CDIC Act applies to Canadian banks and other federal deposit taking institutions (?FIs?).? To facilitate the restructuring of an FI which is on the edge of insolvency, the Governor in Council (Canada) may issue, on the recommendation of the federal Minister of Finance, an order (a ?CDIC Order?) under the CDIC Act vesting the shares and subordinated debt of the FI in the Canada Deposit Insurance Corporation (?CDIC?) or appointing CDIC as a receiver of the FI.? If CDIC is appointed receiver of the FI, the CDIC Order may also direct the Minister of Finance to incorporate a so-called ?bridge institution?.

A bridge institution is created as part of the restructuring process as a subsidiary of CDIC to effect a transfer of the business operations which can be effectively restructured to a new solvent financial institution which can carry on the business on a properly capitalized and solvent basis. If a bridge institution is incorporated, CDIC must provide the financial assistance that the bridge institution needs in order to discharge its obligations as they become due.

When a CDIC Order is made, no creditor has any right of set-off against the FI and no person may terminate or amend any agreement with the FI or claim an accelerated payment under an agreement with the FI by reason only of the insolvency of the FI, a default by the FI or the seizure of assets by CDIC, unless a Canadian court grants leave to do such a thing.? The CDIC Act also contains limited EFC Safe Harbours, which allow the solvent counterparty to exercise rights of termination, netting and realization on financial collateral provided for in an EFC, notwithstanding the broad stay applicable to creditors.

If the CDIC Order directs the incorporation of a bridge institution, the EFC Safe Harbours do not apply and the solvent counterparty is prohibited from exercising its rights of termination, netting and realization on financial collateral by reason only of (i) the FI?s insolvency, (ii) the appointment of a receiver of the FI, or (iii) the assignment to or assumption by the bridge institution of the EFC, unless otherwise ordered by the court.? In order for the stay of the EFC Safe Harbours to be effective, CDIC must provide an unconditional guarantee of the payment by the FI of an amount due or that may become due in accordance with the provisions of the EFC or CDIC must ensure that all obligations arising from the EFC will be assumed by the bridge institution.

The solvent counterparty is not prohibited from terminating an EFC and netting the obligations under the EFC in accordance with its terms where there has been: (a) a non-monetary default by the FI in the performance of its obligations under the EFC; or (b) a monetary default by the FI which is not remedied by the bridge institution within 60 days, or such shorter period as ordered by the court, following the assignment of the EFC.

If the CDIC Order directs the incorporation of a bridge institution, CDIC may assign to the bridge institution any and all assets and agreements entered into by the insolvent FI, including EFCs, notwithstanding any contractual prohibition of assignments.?? If CDIC assigns an EFC to a bridge institution, CDIC must assign all EFCs between the FI and the counterparty and between the FI and any entity that is related to the counterparty. In addition, CDIC must assign the FI?s interest in any property that secures the FI?s obligations under an EFC that is transferred to a bridge institution.?

CDIC is not able to assign an EFC if it has been previously terminated.

Current Law ? The PCSA

The PCSA is intended to promote the stability of the financial system in Canada by giving the Bank of Canada the ability to designate certain clearing and settlement systems and certain clearing houses that operate clearing and settlement systems as systemically important. Where the Bank of Canada has designated a clearing and settlement system or a clearing house that operates a clearing and settlement system, the settlement rules of the clearing and settlement system may benefit from certain exemptions such that the rules of the clearing and settlement system are valid and binding notwithstanding certain provisions of Canadian law and court orders (the ?PCSA Exemptions?). One such PCSA Exemption is an exemption from any law relating to bankruptcy or insolvency and any order of a court, including a foreign court, made in respect of a reorganization, arrangement or receivership that has the effect of interfering with the ability of a clearing house to act in accordance with the settlement rules of its clearing and settlement system. ?Another PCSA Exemption is a protection analogous to the EFC Safe Harbours for ?Netting Agreements?, including EFCs, between financial institutions.

Amendments in Bill C-45

Amendments to the CDIC Act

Bill C-45 introduces a number of amendments to the CDIC Act, including a clarification regarding the duration of the stay of the EFC Safe Harbours that occurs upon the issuance of a CDIC Order directing the incorporation of a bridge institution.? Previously, the duration of the stay was unclear. Pursuant to new section 39.15(7.01) of the CDIC Act, the EFC Safe Harbour is stayed upon the issuance of a CDIC Order directing the incorporation of a bridge institution for a period that begins when the CDIC Order comes into force and ends on the following business day at 5:00 pm eastern time (a ?1 Day Stay?). ?Pursuant to new section 39.15(7.02) of the CDIC Act, a 1 Day Stay does not apply to clearing and settlement systems and clearing houses designated under the PCSA.?

In addition to the 1 Day Stay, new sections 39.15(7.1) and (7.11) of the CDIC Act appear to operate such that the 1 Day Stay becomes permanent upon CDIC guaranteeing the performance of the obligations arising under an EFC or assigning the EFC to a bridge institution.

Amendments to the PCSA

Bill C-45 introduces a number of amendments to the PCSA, including an amendment that broadens certain definitions to make clearing houses that clear derivatives contracts eligible for the PCSA Exemptions and to make collateral posted to such clearing houses qualify as financial collateral.

In addition, the definition of ?Netting Agreement? is amended such that an agreement between a customer and a member of a clearing house that provides clearing and settlement services to that customer qualifies as a Netting Agreement and is therefore granted protections analogous to the EFC Safe Harbours.

The amendments also appear to be intended to clarify the interaction between the limitations on the EFC Safe Harbours provided in the CDIC Act and the PCSA Exemptions.? The amendments create exceptions to the PCSA Exemptions that apply where the effect of the CDIC Order and subsequent actions by CDIC stay the EFC Safe Harbours provided for in the CDIC Act. ?The apparent purpose of these amendments is to provide designated clearing and settlement systems and designated clearing houses (i) with an exemption from the 1 Day Stay so that they can terminate EFCs with an insolvent financial institution before such EFCs are transferred to a bridge institution; and (ii) a limit to that exemption such that they are stayed from terminating any EFCs that have been guaranteed by CDIC or transferred to a bridge institution.

Comment

We welcome the apparent intention behind the amendments proposed in Bill C-45. Clarity is desirable as to the duration of the stay of the EFC Safe Harbours that occurs upon the issuance of a CDIC Order directing the incorporation of a bridge institution. ?Clarity is also desirable as to the interaction between the CDIC Act and the PCSA.

The amendments to CDIC Act and the PCSA appear to operate such a 1 Day Stay applies upon the making of a CDIC Order that directs the incorporation of a bridge institution, but the 1 Day Stay is subject to the PCSA Exemptions. The 1 Day Stay appears to become permanent upon CDIC guaranteeing the performance of the obligations arising under an EFC or assigning the EFC to a bridge institution.? Upon the stay becoming permanent, it appears that the PCSA Exemptions no longer apply.? Greater clarity would be helpful regarding the interaction between the 1 Day Stay, the permanent stay and the PCSA Exemptions.?

The Jobs and Growth Act received second reading in the House of Commons on October 30, 2012.? It has now been referred to committee for further study.? Hopefully the committees studying Bill C-45 will address these issues before the Jobs and Growth Act becomes law. We will provide an update on this matter as it develops.

Specifically, the PCSA Exemptions do not apply where sections 39.15(7.01), (7.1) and (7.11) of the CDIC Act apply.

NFL GOIN' DEEP: Panthers put presidential polls to rest

With the help of Cam Newton, a pattern in Washington tells us who the next leader of America will be.

Richard Lipski/AP

With the help of Cam Newton, a pattern in Washington tells us who the next leader of America will be.

To all my family and friends in Breezy Point, I hope you?ll get a laugh or two here?today. Thoughts and prayers are with you all during this horrific time. Words cannot describe. So until we all meet again at the ?Sugar Bowl? to talk football in the not-too-distant future, stay strong. And laugh when you can.

MEET THE NEW BOSS
Gallup polls? Rasmussen polls? Who needs them? The Carolina Panthers have already taken all the suspense out of the presidential race. And your winner is?

Mitt Romney.

You see, since the Redskins started playing in Washington D.C. in 1937, after relocating from Boston, the outcome of their final home game before a presidential election has been an uncanny indicator of who will win the election. Before yesterday, the last nine times the Redskins won their final home game prior to the election, the incumbent party won the election. The last nine times they lost at home, eight times the incumbent lost (George Bush won in 2004 after a Skins loss to Green Bay). So prior to yesterday?s game you had to figure the Obama camp was feeling pretty good about itself as the Panthers came to town toting a five-game losing streak, including the last four by a combined 12 points. But Cam Newton threw for one score, ran for another and before Obama could say, ?You didn?t build that,? the Panthers had built 21-6?fourth quarter lead. Washington did cut it to a touchdown with?1:34?to play, but when Carolina recovered the onside kick, the Romney camp was popping champagne and Mitt went to work on his acceptance speech. Or so we heard.

The Redskin Rule, as it has become known, has a 94.8% accuracy rate. So, meet the new boss. Thanks to Cam and the Panthers.

GET?A LAWYER
A man in China sued his wife for giving birth to a really ugly baby ? and he won!

The unidentified Chinese dad won a $120,000 judgment against his wife for giving birth to a baby that Daddy Dearest dubbed ?horrifyingly? ugly. Now if this cretin can cash in on an ugly baby, exactly what kind of payouts do you think await litigious-minded Browns? fans who have been forced to pay to watch horrifyingly ugly football since a couple of ancient Chinese architects got together and said, ?Hey, why don?t we build a Great Wall to keep the invaders out?? (OK, it just seems that long).

There seems to be no end to Browns fan?s misery and it continued?Sunday?against the Ravens. Five times the Browns pop-gun offense found itself inside the Ravens 20-yard line and five times the Browns pop-gun offense couldn?t find the end zone. Five times Phil Dawson was called on to kick a field goal and five times he nailed it. Such is life when you?re offense is ranked 29th?overall and you?re one Phil Dawson leg cramp away from having no offense at all.

The Browns are now 2-7?after their 10th?straight loss to the Ravens and are on their way to yet another losing season. In fact, the Brownies have had just two winning seasons (2002 and 2007) since rejoining the league in 1999 with just one playoff appearance.

The good news? The Browns are on their bye next week ? which would present the perfect opportunity for Browns fans to contact their lawyers.

ORANGE AND BLACK?AND BLUE
I was sure this was going to be the year. The year BengalsNation (sadly were down to six warm bodies at last count) could rejoice in its first ever victory over Peyton Manning. A win that would not only get that colossal monkey off our Orange and Black backs, but would also end our three-game losing streak and catapult us back into the AFC playoff race. And it all looked so promising when Andy Dalton led us to 17 straight second-half points to put us up by three in the fourth quarter and it was off to the kitchen to mix the celebratory cocktails of Southern Comfort and Guinness. (Something orange and black). But before we could even take our first sip, Manning has thrown a pair of TDs, we?re down 11 with 3:36 to play and well, now we?ve just scheduled more drinking time. Like until?Tuesday.

We?re now 3-5?with the Giants on deck and 0-8?lifetime vs. Peyton. Criminy. We in BengalsNation like to refer to our?Sunday?afternoons as ?Bengals Time.? Lately though, it?s more like ?doing time? ? without the guard towers and barbed wire.

LOTS OF ?LUCK?
There may be no better story this season than the Colts. Playing without their ailing coach Chuck Pagano, who is battling leukemia, Indy got an NFL rookie-record 433 passing yards and two TDs from Andrew Luck as the Colts knocked off Miami to go?to 5-3. After the game Pagano addressed the team and said, in part, ?The vision that I?m living (is) to see two more daughters get married, dance at their weddings and hoist that Lombardi (trophy) several times.?

If you?re not rooting for the Colts at least a little this year, you don?t have a heart.

QUOTE OF THE DAY
?You lose a game like that, now you?re playing to see who obviously is going to be on your football team for years to come. I?ll get a chance to evaluate players and see where we?re at.?

Redskins coach Mike Shanahan after Washington fell?to 3-6?in a home loss to Carolina after committing 13 penalties for 97 yards.

BAD BET
Only 8:48 stand between the Browns and a win. Not just a cover, but an actual win. So up, 15-14, and getting 3 ?? We are positively giddy. Of course in that final 8:48 Baltimore scores 11 straight points on its next two possessions and the Browns make damn sure our grandiose dreams die a quick death in a 25-15 loss.

How To Hire A Good E Commerce Website Builder - PDF

How To Hire A Good E Commerce Website Builder

Why would anyone hire a website builder or designer when they could do it themselves? It's not easy
or not every DIY site is appropriate for every business. There are times to hire a professional instead
of using a template and web maker yourself.
Almost every business, whether it be a one person operation or large corporation, needs to have a
presence on the web. In order to announce your service, provide needed information to the public or
private client, update information or sell directly in an e-commerce setting, a website is essential.
Even though millions of us are very adequate with a computer and getting around the Internet, there
are just as many who have no experience with computers. This was written for the latter.
I have to inform my readers that I am not a professional IT person and have a basic knowledge about
some html coding and design. I do know professionals in this profession and they are the most hard
working, reliable and honest people in the field. They are beyond reproach, but occasionally a bad
one slips between the cracks.
It wasn't that long ago that consumers and business clients were at the mercy of some unscrupulous
webmaster.
Several friends and family members, including myself, have had negative experiences dealing with
webmasters or more like web builders, in the past. They dealt with a web builder that was non
responsive to emails and phone messages, or didn't clearly define just what services were covered
when building the site.
Another big problem is administration of the website once it's up and running. A number of friends
were almost knocked out of their business because they made the mistake in trusting the person who
built their site to handle the necessary changes when needed. The only problem with that was that
they didn't. The business owners were frantic because the information was old, or just plain wrong.

Years ago I had the unfortunate experience of hiring a site builder from a winning bid to build a tutor
registry for me. I gave the examples of three sites that I liked the functions and looks of as a guide to
build mine. Unfortunately the web site builder copied one of those sites exactly, only he changed the
color schemes.
I found out when the original owner threatened me with copyright infringement and a lawsuit. It was at
that time that I also found out that the 'webmaster' wasn't a real full time website builder at all, but a
college student that didn't live where he stated on the bidding site nor did he take down the site after
many requests. He claimed to be from the states but really lived overseas. I had to close the account
with the web host. What a valuable lesson I learned!

Today, there are many bidding sites with reliable background checks and feedback forums so a client
can make an informed decision. A very important. Point is to ask about any certifications such as
such as Microsoft offers.
There are many others so check this link.

Consumers can also have a choice of new self building website companies that make the e-
commerce and online business presence much saner and smoother running.
With website building sites such Weebly, Wix, Yahoo, Intuit, Google and so on, allow anyone who
wants a website to build one and online platforms such as Face book, Twitter to spread the word
about your business. We've really come a long way in 10 short years.

If you pay someone to build a website there are still some points you need to be aware of. From
personal experience you need to be very vigilant about these points.
1. get reliable referrals from the website builder
2. research and check the sites given
3. make sure the content isn't stolen
4. hire a lawyer to check the contracts
Getting reliable referrals is a tricky item to confirm; its a lot like getting referrals for home remodeling,
car repair or even a babysitter. It really depends on who you are dealing with and trying to determine
if their referrals are real or not. We all know that friends and family members will help someone with
glowing recommendations.
Researching the websites they claimed to have made is easy enough, but I have done this and to my
amazement many are not real websites. In other words, when I click on any links on the site, they go
nowhere or are non-functioning. You'd be surprised how many people don't thoroughly check out
each site given. Don't be so quick to believe them. If they are new and need clients they can build
free ones for non profits or make up a mock business. The idea is to see if they are any good at
building a reliable site.
The third point is very important. The content on a website has to be real and either written by the site
builder or bought and paid for to place on the site. I can't emphasis this point enough because so
many of us website content writers do this for a living. We get paid to write content. There are many
site builders that simply find the content they need, copy and paste it on the site. I have found so
many articles of mine on websites. They don't realize that's is stealing?
Unfortunately I had to file complaints with web hosting companies and inform site owners that my
work is stolen. This could very well be a full time job. If you agree to have someone make you a
website and give them carte blanch to fill the content then you as the owner must check the content.
Go online yourself and Google or pay someone to check it.

The reasons to hire someone to build a site for you are varied.
* You may be extremely busy and simply do not have the time to build even the simplest of sites.
* You may have a fear of the Internet and do not trust yourself to handle it.
* If you have no experience using a computer than leave it to someone else.
* The e-commerce sites can be complicated and require too much coding and updates to handle.
* You need to tend to your brick and mortar store to make your living.

Just remember my four points when hiring someone. Get reliable referrals and speak to people about
them. Check the websites out thoroughly and make sure they are real. Call any numbers and act like
a customer.
Most important make sure the content on your own website is not stolen. Make them show you record
if they bought it. Check online by typing in some content or hire someone to check their work out. Just
make sure they don't know each other.
Last, but not least of all, be sure your lawyer has a contract in place. He or she can run a credit check,
background check or criminal check. You are giving them financial and personal records so the
webmaster shouldn't refuse to give you their companies information. Yes some new ones will start out
as a sole proprietor so don't let that dissuade you. Hammer out responsibilities on both sides.
Even though I have used the terms website maker, website technician, webmaster, I think those
terms are most known to consumers. If you stick to most of these points, you should feel secure and
safe about your decision.

So, I?m not going to sit here and talk to you like a child ? you?re already smart enough to figure out, you need some inside tips. I?m not talking about a measly recipe, 10 or even 20. No. I?m talking about the kind of stuff that people keep in the family and never tell no matter what.

I?m going to reveal a ?detailed?, step-by-step systematic solution that will bring YOU a LOT of BARBECUE CHAMPIONSHIP TROPHIES which in effect will bring you alot of RESPECT and BRAGGING RIGHTS too. I will take you from the position you are at right now to a level where you once thought was an impossible dream.

Oh yeah, and one other huge benefit is? there is SERIOUS cash to be Won and Made with Killer Barbecue, and for it to happen you NEED MY SYSTEM.

There?s no question about it. To win barbecue championships you need to know my secrets and after you apply my system?

That wasn?t a misprint as I have won over 70 barbecue trophies across the United States in the last 2 years. I?ve won barbecue contests in the South, the East, the West, the Midwest, you name it.

I?ve also tried using the conventional ways of barbecuing, using conventional barbecue recipes and techniques? and EACH ONE wasn?t good enough to consistently win 1st place barbecue trophies without a lot of luck and a lot of hassle.

Do you have any idea how sick and tired I was after months and months on end, using these techniques ?COMBINED?, just to win a couple second and third place barbecue trophies?

But that?s not all? do you know how many hoops you have to jump through, red tape and rules you?re suppose to follow using the typical boring methods? Here?s a small set of problems you?ll encounter?

The number of rules you have to follow and the endless hours of work you have to do is ?unbelievable? to say the least. But what did you expect? An easy route?

I?ve tried all the so called secret bbq recipes with average results. I?ve bought book after book, guide after guide, and watched show after show, and hey I?ve learned a few things here and there, but?

Right up until late 2008, when things quickly began to change for me. My tiring quest for answers finally paid off as I began to uncover the TRUTH behind making the best barbecue recipes in the world? and it had nothing to do with the usual hard work and usual old methods they?ve been shoving down your throat either.

And since that revelation hit me, everything changed. I had a life ?makeover?. I became a new person.

Then I was bombarded ? by every person that had ever heard of me, not just from the barbecue competition crowd, but also from hundreds of backyard cooks, spectators, and even multi-national companies.

They all wanted to know my secrets? how the heck was I able to win competition after competition? How was I able to dominate? Read more?

'Don't Know Much About the American Presidents': Kenneth C. Davis reveals strange facts about America's leaders

George Washington breaking the law? The president with the most corrupt presidential administration in American history? Writer Kenneth C. Davis discusses surprising facts about our past leaders.

By Erik Spanberg / October 24, 2012

Kenneth C. Davis's book, 'Don't Know Much About the American Presidents,' is a follow-up to 'Don't Know Much' titles that examine general history, the Bible, and the Civil War.

Did you know that Americans didn?t start voting for president on the same day until 1845? Or that George Washington wasn?t our nation?s first president? Another Virginian, Peyton Randolph, a longtime member of the House of Burgesses, won an election as the first president of the Continental Congress in 1774, succeeded by a baker?s dozen of leaders before the ascension of Washington to the presidency as we know it.

What about the presidential origins of the word ?okay?? Thank Martin Van Buren, whose birthplace of Old Kinderhook, N.Y., in initials, made way for okay. Or OK, if you prefer.

Did you know that Jimmy Carter was our first president born in a hospital? Or that, 225 years ago during the debates that led to the creation of the commander-in-chief, the job ?was being invented by men who didn?t necessarily think that having a president was such a great idea??

The latter quote comes from the pen of Kenneth C. Davis, a man known to millions of readers for posing endless questions and then answering them with detailed but snappy historical facts and anecdotes. This accidental historian, nudged by his wife into writing while working at a bookstore, burst on to bestseller lists in 1990 with ?Don?t Know Much About History,? a pop history confection that spawned a series of similar titles on geography, the Bible, and the Civil War.

The latest entry, "Don?t Know Much About the American Presidents," follows the popular formula Davis established throughout the series. He offers the basic cornerstones ? biographies of each president, important legislation and decisions, controversies and scandals ? along with all manner of Oval Office bric-a-brac, starting with origins of the Oval Office itself, which was built during the administration of William Howard Taft (who weighed 300 pounds and still ranks as the heaviest president in history), but never described as the Oval Office until the days of FDR.

Beyond history and historical oddities, Davis weaves in memorable quotes from the presidents and supplies extensive lists of essential reading and websites for those wanting to learn more about various presidents and aspects of the presidency.

As the nation stands on the cusp of Election Day, following a 220-year tradition that formally began with Washington in 1789, Davis is happy to remind us of how we, and POTUS (that would be the President of the United States), got here. Following are excerpts from a recent conversation Davis had with the Monitor on mudslinging campaigns, overlooked presidencies and more.

In the introduction, you mention a school project from 1963 about the presidents and your admiration for JFK. Is he still your favorite president?

I would not say he?s my favorite president. The history behind that ... and I?m actually holding it in my hands as we speak, this piece of art, as I call it, from 1963, my third-grade school project. I did go to the Holmes School in Mount Vernon, New York, of course named for Washington?s famous plantation and, obviously, when I was nine years old, I was still thinking about this stuff. Of course, October 1963 was a month before the world changed for all of us in the loss of Kennedy.

When I look back at this [childhood] book, which I wrote 49 years ago, it?s funny because I did ask questions from the first page. So I was obviously interested in information about history from a young age. And I say this very, very seriously, I also have on my desk a toy wooden revolver that I was given as a souvenir from going to Gettysburg in the summer of 1963.

Beau Biden Defends Father's VP Debate Performance

Delaware Attorney General Beau Biden defended his father Vice President Joe Biden's debate performance, saying his laughter and facial expressions did not undermine the substance of his comments at last week's debate.

"I'm happy to defend my dad. I don't think he needs any defensiveness. Any time the other side - Karl Rove or folks on the far right - are going after my father for smiling too much, you know that's a victory," Beau Biden told me this morning on "This Week." "My father spoke clearly to the American people about the facts, and you saw him do that for 90 minutes straight."

"This isn't, Jake, about how much my father smiled or how many gallons of water that the congressman drank nervously on that stage," Biden quipped. "It's about talking directly to the American people about very important facts."

Biden charged Republican vice presidential nominee Rep. Paul Ryan with not being "up to speed on foreign policy," criticizing Ryan for his comments during the debate on troop levels in Afghanistan.

"You had him suggest, if not open the door, to put additional troops in Afghanistan. So it was a remarkable position to take," Biden said. "It demonstrated, I think, that, you know, the congressman is not quite up to speed on foreign policy as you might want a would-be vice president to be."

"The point that I heard and the American people heard is that you heard my father clearly articulate that we wouldn't have forces in Afghanistan by 2014," Biden added, "and you've seen here the congressman equivocate on that, in fact, not be willing to guarantee the American people that we wouldn't have forces in Afghanistan."

Beau Biden also defended Vice President Biden for saying at the debate that "we did not know they wanted more security again," regarding American officials in Libya requesting more security before the attack that killed four Americans at the consulate in Benghazi last month.

The Obama administration said the vice president was referring to the White House not knowing about the security request, despite the State Department being notified. "He was speaking for himself and the president, as you heard Jay Carney tell you in the briefing room just the other day," Beau Biden said.

Biden criticized the Romney campaign for politicizing the Libya issue, saying "These are folks that seem to be more interested in kind of pounding their chest to make the neoconservatives who advise them proud than they are about being serious about foreign policy and protecting our national interests around the world."

"This is a tragedy when we lose an ambassador and three other personnel," Biden said. "This is not a moment in time where we should be politicizing these issues? And the idea that Romney and Ryan are suggesting that the President of the United States doesn't take seriously the security of our diplomats and Foreign Service officers around the world I find absolutely outrageous."

Tom Hanks to make his Broadway debut next year

NEW YORK (AP) ? Tom Hanks will play a gutsy New York City newspaper columnist when he makes his debut on Broadway in the spring.

Producers of Nora Ephron's play "Lucky Guy" announced Thursday that Hanks will play Mike McAlary in the stage biography. Hanks, a two-time Oscar winner, had been in negotiations for the role when Ephron died this summer.

Previews begin March 1 at the Broadhurst Theatre and an opening night is set for April 1.

McAlary, the city's one-time dominant tabloid reporter, got the first interview with Abner Louima, a Haitian immigrant who was sodomized and beaten by white police officers at a station house in 1997. McAlary would win the Pulitzer Prize the next year but would die of cancer a few months later at age 41.

The director of "Lucky Guy" will be George C. Wolfe.

In June, lead producer Colin Callender said his team could "think of no more fitting tribute to her extraordinary writing and remarkable body of work" than to proceed with plans to produce Ephron's play.

Hanks is the star of such films as "Splash," ''Forrest Gump," ''Philadelphia," ''Sleepless in Seattle," ''Apollo 13" and "Saving Private Ryan."

Ephron, who died June 26 at age 71, gained recognition as the writer of films such as "When Harry Met Sally" and "Sleepless in Seattle," which starred Hanks.

McAlary, who worked at both the New York Daily News and The New York Post, has already been the subject of a play ? Dan Klores' "The Wood," which opened off-Broadway at the Rattlestick Playwrights Theatre last year. He was said to be the inspiration for the character played by Randy Quaid in Ron Howard's "The Paper."

(AP) ? Tour de France director Christian Prudhomme says the race will have no winner if the International Cycling Union goes along with American officials' ruling to strip Lance Armstrong of his seven titles from 1999-2005.

Prudhomme says this week's U.S. Anti-Doping Agency report on Armstrong is "damning" and calls into question "a system and an era."

The cycling union, which governs the sport internationally, has less than three weeks to decide whether to appeal USADA's decision to ban Armstrong for life and erase his racing results.

In China on Friday, UCI President Pat McQuaid refused to comment on the USADA report, which offers the rationale for its ruling in the Armstrong case. The document portrays the cyclist as a doper who pressured teammates to also take performance-enhancing drugs.

Paul Ryan's Diet and Fitness vs. Joe Biden's Diet and Fitness

As vice presidential candidates Paul Ryan and Joe Biden battle for the country?s vote, we are looking at the politicians in a different light ? that of their physical fitness and personal diets. Will the person who can do the most pushups be the best as second-in-command? Maybe not, but it does say something about them, however you may interpret it.

Congressman Ryan, 42, is well-known for his love of exercise. He is a devotee of P90X workouts, the high intensity DVD program developed by Tony Horton, frequently leading sessions in the capitol?s gym. The grueling sessions range from 60 to 90 minutes, combining cardio workouts, weight training, yoga, and stretching for an extensive training routine that really pushes your body.

Ryan?s rumored six-pack abs have had their own set of scrutiny, with more Google searches of ?Paul Ryan shirtless? than ?Paul Ryan budget? after the announcement in August that he was running alongside Romney. Out of college, he worked as a personal trainer and enjoys as sport skiing and hiking. If catfish noodling counts as a sport, he does that, too.

Ryan reports that he is six-foot-two, 163 pounds, and keeps his body fat between 6 and 8 percent. To maintain his lean physique, his diet doesn?t include many indulgences. While other politicians on the campaign trail cave to the offerings of greasy meals, fried foods, and sweets, Ryan politely declines. He rarely eats desserts, but when he does make a stop at the ice cream shop he chooses a soft serve cone. He says his worst habit is his daily two cups of coffee. What?s lesser known is that Ryan is concerned about his health in part because his father died of a heart attack when Ryan was 16, and his grandfather and great-grandfather also died of heart disease. He?s determined not to share that fate.

Joe Biden is less enthusiastic about food and diet, but the 69-year-old keeps himself in shape despite a workload helping to manage the country. He likes running, biking, and strengthening his core. He played football in high school and college, admittedly enjoying the sport much more than his studies. Nowadays, he mainly sticks to?gym workouts, including lifting weights and dropping by the Senate gym with his old colleagues when he has time.

Biden?s favorite cuisine is Italian, and pasta is his favorite dish. When dining out at an Italian restaurant close to his home, he reportedly often orders penne with tomato sauce and basil. He is much more likely than Ryan to indulge in whatever scrumptious food is offered to him on the campaign trail. He says time with his five grandchildren helps keep him spry.

Whoever wins the title of the next vice president is sure to make their health a priority. Good fitness and nutrition practices help cut down on sick days, boost mental clarity, and improve mood and energy levels. The vice president needs all of these things and more, so it?s good to see this year?s candidates giving important consideration to their well-being.

(AP) ? Joaquin Arias hit a grounder toward third base and took off, covering those 90 feet in a blink as a full-to-capacity ballpark went silent with angst.

Which would get there first, the infielder or the ball? Who would win the decisive playoff dash?

"That's the fastest I've ever run to first," Arias said.

Fast enough to extend the San Francisco Giants' season one more day.

Reds third baseman Scott Rolen bobbled the short-hop, giving Arias enough time to beat the throw as the go-ahead run scored for a 2-1 victory Tuesday night that avoided an NL division series sweep.

Hardly able to get a hit the last two games, the Giants turned a passed ball and a misplayed grounder into a win that cut their series deficit to 2-1 and extended Cincinnati's 17 years of home postseason futility.

"These are the type of games we've played all season long," said Sergio Romo, who pitched the last two innings for the win. "We are a gritty and grinding team."

And, with their season on the line, a little lucky, too.

"We got a break there at the end," manager Bruce Bochy said.

Left-hander Barry Zito will pitch Game 4 on Wednesday for the Giants, who have won the last 11 times he started. The Reds have to decide whether to try ace Johnny Cueto, forced out of the opener in San Francisco on Saturday with spasms in his back and side.

Manager Dusty Baker said after the game that they hadn't decided whether to let Cueto try it, bring back Mat Latos on short rest again, or replace Cueto with Mike Leake, who wasn't on the division series roster.

Switching out Cueto would leave the Reds ace ineligible to pitch in the championship series should the Reds get that far.

"It's very difficult, but it all depends on if your ace can't go or whatever it is," Baker said. "That's part of the conversation ? us going without him. We realize what's at stake."

They were hoping to avoid having to make that choice. One grounder forced the issue.

The Giants managed only three hits against Homer Bailey and the Reds bullpen, but got two of them in the 10th ? along with a passed ball by Ryan Hanigan ? to pull it out. San Francisco won despite striking out 16 times.

Rolen, an eight-time Gold Glove winner, couldn't cleanly come up with Arias' grounder, which put him in a tough position.

"I've gone through the play many times in my mind between then and now, and I think I would play it the same way," Rolen said. "It hit my glove. I just couldn't get it to stick."

The Reds haven't won a home playoff game since 1995, the last time they reached the NL championship series. One win away from making it back there, they couldn't beat a Giants team that has barely been able to get a hit.

San Francisco got only two hits while losing 9-0 on Sunday night, setting up that 2-0 deficit in the series. The Giants had only one single in seven innings off Homer Bailey, making his first start at Great American Ball Park since his Sept. 28 no-hitter in Pittsburgh.

Fortunately for the Giants, Bailey's one lapse led to a run. He hit a batter, walked another and gave up a sacrifice fly by Angel Pagan in the third inning.

That was it until the 10th, with the Giants going down swinging ? the Reds set a season high with 16 strikeouts. Closer Aroldis Chapman got a pair of strikeouts on 100 mph fastballs during a perfect ninth inning, keeping it tied at 1.

San Francisco's one-hit wonders finally got it going against Jonathan Broxton, who gave up leadoff singles by Buster Posey ? the NL batting champion ? and Hunter Pence, who pulled his left calf on a wild swing before getting his hit.

With two outs, Hanigan couldn't come up with a pitch, letting the runners advance. Moments later, Cincinnati's chance for a sweep was over.

Instead, a Reds team that lost a lot ? closer Ryan Madson in spring training, top hitter Joey Votto for six weeks at midseason, Baker for the NL Central clincher, Cueto in the first inning of the first playoff game ? ended up with another playoff loss at home.

Baker was back in the home dugout at Great American for the first time in nearly a month, recovered from an irregular heartbeat and a mini-stroke. After a pregame ovation, he settled in his red folding chair with a toothpick on his lips.

The 63-year-old manager watched his pitching staff dominate again, but fail to get that breakthrough win. This time, the offense came up short, getting only four hits.

Cincinnati hasn't won a home playoff game since beating the Dodgers 10-1 at Riverfront Stadium for a three-game division sweep in the 1995 NLDS. They then got swept by Atlanta.

They didn't get back to the playoffs again until 2010, when they got no-hit by Roy Halladay and swept by the Phillies in the opening round.

The second-largest crowd in Great American history was still getting the hang of playoff rooting. A video board message instructed the 44,501 fans not to wave white rally towels while the Reds were in the field ? could be distracting.

Didn't take long to get those towels twirling. Brandon Phillips led off with a single, but was thrown out at third when he tried to advance on a ball that got away from Posey. It was costly ? the Reds went on to score on a walk and a pair of singles, including Jay Bruce's RBI hit to right.

The Reds got only one more hit the rest of the way.
